Introduction & Acceptance

Welcome to BeanHub. These Terms of Service ("Terms") govern your use of the BeanHub website at beanhub.com.au ("Site") and the services provided by BeanHub Australia Pty Ltd (ACN 694 445 344) ("BeanHub", "we", "us", or "our").

By accessing or using our Site, creating an account, or making a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

Section 2

Definitions

  • "BeanHub" refers to BeanHub Australia Pty Ltd and the BeanHub marketplace platform.
  • "Merchant" or "Roaster" refers to the independent coffee roasters who list and sell their products through BeanHub.
  • "Customer" or "you" refers to any person who accesses the Site or makes a purchase.
  • "Products" refers to the coffee and related goods listed for sale on the Site.
  • "Order" refers to a request to purchase Products through the Site.

Account Registration

You may browse the Site without an account, but to make purchases you must:

  • Provide accurate and complete information
  • Be at least 18 years old or have parental consent
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Section 4

Our Marketplace Model

BeanHub operates as a marketplace that connects coffee lovers with independent specialty coffee roasters across Australia.

  • BeanHub facilitates: The platform, payment processing, and customer service
  • Roasters provide: The products, roasting, packaging, and shipping directly to you

When you place an order, you are purchasing products from the relevant Roaster(s), with BeanHub acting as the facilitating platform.

Orders & Payments

Pricing

All prices displayed on the Site are in Australian Dollars (AUD) and include GST where applicable. Pricing displayed on the platform is determined by BeanHub. Shipping costs are calculated separately at checkout.

Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We accept major credit and debit cards.

Order Confirmation

After placing an order, you will receive an email confirmation. This confirmation constitutes acceptance of your order. We reserve the right to cancel orders in cases of pricing errors, suspected fraud, or product unavailability.

Multi-Roaster Orders

If your order includes products from multiple Roasters, each Roaster will ship their portion separately. You may receive multiple packages for a single order.

Shipping & Delivery

Please refer to our Shipping Policy for detailed information about shipping methods, timeframes, and costs.

  • Roasters ship orders directly to you
  • Delivery timeframes are estimates and not guaranteed
  • Risk of loss passes to you upon delivery
  • You are responsible for providing accurate delivery information

Returns & Refunds

Please refer to our Refund Policy for detailed information about returns, refunds, and your rights under Australian Consumer Law.

Coffee is a perishable product. We do not offer refunds for change of mind or taste preference. However, we stand behind product quality and will address any issues with damaged, defective, or incorrectly described products.

Section 8

Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee.

Section 9

Intellectual Property

The BeanHub name, logo, website design, and content are owned by or licensed to BeanHub Australia Pty Ltd and are protected by intellectual property laws.

Product images, descriptions, and branding for individual coffees are owned by their respective Roasters and are used with permission on our platform.

You may not reproduce, distribute, or use any content from the Site without prior written permission.

Section 10

User Conduct

When using our Site, you agree not to:

  • Violate any applicable laws or regulations
  • Provide false or misleading information
  • Engage in fraudulent transactions
  • Interfere with the Site's operation or security
  • Collect user information without consent
  • Post harmful, defamatory, or inappropriate content
Section 11

Limitation of Liability

To the maximum extent permitted by law:

  • BeanHub provides the platform "as is" without warranties of any kind, except as required by law
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Site
  • Our total liability for any claim is limited to the amount you paid for the relevant order

These limitations do not apply to any rights you have under the Australian Consumer Law that cannot be excluded or limited.

Section 12

Dispute Resolution

If you have a dispute or complaint:

  • Contact us first: Email support@beanhub.com.au with details of your concern
  • We will investigate: We aim to respond within 5 business days
  • Escalation: If unresolved, disputes may be referred to mediation or the relevant consumer protection body
Section 13

Termination

We may suspend or terminate your account and access to the Site at any time if you breach these Terms or engage in conduct that we reasonably believe is harmful to BeanHub, our Roasters, or other users.

You may close your account at any time by contacting us. Termination does not affect any existing orders or your rights under consumer protection laws.

Section 14

Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from those courts.

Section 15

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

For significant changes, we may notify you via email or a prominent notice on the Site.

Section 16

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
